I have been informed by the Ombudsman in Belize City that Coral Beach Realty has now been retroactively registered for GST from the 1st December 2008. Mr Bob Hamilton has disputed with the GST Office that I paid him BZ$4,200.00, but has accepted the ruling of the GST Office and will make payments to them. He has also stated the payments will not be immediate and will come in portions as soon as possible. I can not believe I am the only one Bob has done this to in the 5 years he has been open.

All we wanted is for the Government to receive the money and not come back to us for the payment. Then you must be happy. Congratulations on seeing this through when many others would have given up.

Sounds highly suspect - they didn't seem to be trading in anticipation of later registration. Any backhanders involved?

We are happy that this matter has come out and is over as far as we are concerned. How Bob can dispute we paid him GST is beyond us as it states in BLACK and WHITE in his Sale of Property Agreement that we have been charged by him for GST. Coral Beach Realty was only registered for GST on the 1st Dec 2008, Bob Hamilton has committed FRAUD as he sold our property on the 27th April 2007 charging us GST knowing he was not registered for GST and trying to keep the money.
It is now in the hands of other pepole.

Fraud is a dangerous word to be throwing around.

Nobody has been convicted, or even charged, that we have heard of. Fraud is a word that connotes criminal activity. Intention is the key. Not all sexual intercourse is rape, not every killing is murder, not every taking of money is fraud. Who are we to judge?

From Wiki "In the broadest sense, a '''fraud''' is an intentional [[deception]] made for personal gain or to damage another individual."
I am not judging anything here as this is not my case, but as stated above, the GST was collected with no intention of remitting. That means it was collected under deceitful terms and the collector was to personally gain from it.
If it looks like a duck......

2ag, you have accepted inplub's explanation. I haven't heard the realtor's explanation, nor would I expect him to give it here. You and I can agree to disagree.

The great thing about this board is that the Realtor is welcome here to argue his case.

With the way real estate works down here as there is really no such thing as an escrow account (lawyers charge 2% of the purchase price-which is an awful lot of money for doing very little but your money is protected and you will get what you paid for -if you use the right lawyers).
I was talking to Chris Allnatt from Pelican Properties and he said that he had 700k of clients monies in his account -this is a lot of money and I trust Chris implicitly having known him for 10 years, having bought a number of businesses and properties from him and just knowing him generally as a totally honest person. However not everyone is the same while I am not saying Coral Beach are dishonest but not filing for GST registration, until this year does not give me that warm fuzzy feeling, and I would definitely use a lawyer if I was dealing with this company.
